It’s so easy for sellers to mistakenly think for sale by owner is the way to go when you need to save money on selling a home, whether it's in San Jose, Calif. or Manhttan, NY.

I've been cautioning my Silicon Valley clients in San Jose, Saratoga, Cupertino and Palo Alto for the past two years to expect an attack on the mortgage interest deduction. Most people have thought I was overreacting.

However, now we hear the Deficit Commission has proposed changing the current mortgage interest deduction as a way of balancing the budget.

NAR's 2001 president Ron Phipps is encouraging all agents to let Congress know that changing the mortgage interest deduction will negatively influence the economy and housing markets. People who are now considering buying a home will hesitate, uncertain as to whether the benefit will continue. We already know that hesitation can be financially painful, even deadly, to the housing market.

Veteran's Day is this Thursday, November 11. It's not too late to participate in the Wreaths Across America Thanks-A-Million-Campaign. The nonprofit needs Your Help To Meet The Goal Of Thanking One Million Veterans

Help Us Distribute 1 Million Thank You Cards By Veterans Day!

Over 500,000 thank you cards were distributed by Memorial Day. The number went over 700,000 by the end of summer. But they still need your help complete the 'Thanks-A-Million' goal of distributing one million thank you cards to our veterans, active military, and their families.

It is a small token but all together a big way of saying we appreciate a veteran's service and sacrifice - and we will never forget.

If you aren't familiar with the Wreaths Across America thank you cards... here's the story:

If you are reading this than you are likely of the same mind that we are - that all those who serve in harm's way and sacrifice to provide our freedoms, deserve to be thanked. And without appreciation for what we have and enjoy on a daily basis, those priveleges might one day disappear.

We all know we should do it, but how do you approach a veteran - and say thank you? That's what the thank you card does. It is a proper excuse, and a keepsake at the same time. And with each single card we are telling all those who served - and their families - we will never forget.

David Haskell of NH wrote in to Wreaths of America to share how he when he distributes his cards, he gives away two. One for the person he is thanking (he signs his name on it) and a second for the recipient to give away and keep the line moving. (I love this idea and plan to try it myself this year.)

Ask anyone who has shaken a hand and offered the card - the experience is as important and moving for the giver as it is for those we thank.

And the best part is, THEY ARE FREE! ($5 shipping & handling per 100 business-card sized thank you cards). And there are only 200,000 left!

Why It's Wrong to Treat Distressed Listings Like Regular Sales

In a recent post an agent asked Short Sale agents to consider not pricing the homes so low "just to get a quick sale. Price them at a fair price to begin with and if your not getting showings then tell the home owner up front you will lower by $5000 - $10,000 bi-weekly depending on the price range. Let's keep the values up it's better for all of us in the end."

Even though I am a neighborhood expert in homes in Lynbrook and Cupertino Schools (San Jose, Saratoga and Cupertino) and would love nothing better than to help current owners maintain value, I am not in charge of economic or market forces. It sometimes surprises people to learn it is ethically wrong for listing agents to try to artificially "prop up" property values.

Market value is ONLY what a willing, qualified and able buyer and seller agree upon. I will give them comparable sales data and counsel each party about their goals and whether this transaction can meet them - but the buyer and seller make the final decisions, not me.

There are offers I've presented where I feared the owner might shoot me because they were so insulted...yet they accepted. And other offers where it was reasonably close (within less than 1 percent) and they rejected.

They decide, not me.

Distressed property owners and listing agents need to MOVE the properties fast-they often do not have the luxury of time. Not only are there the notice of foreclosure and trustee sale timelines, there is the sobering reality of added health risks that these situations place on homeowners.

Can you live with yourself if your client suffers a heart attack or attempts to commit suicide because your real estate advice was to "hold on the price another month" only to have another short sale or foreclosure pop up at a lower price-and sell?

Many of the people I'm helping through these situations suffer from high blood pressure, diabetes and heart conditions - they are already fragile and trusting me to guide them out of danger to a safer place.

In my opinion, getting a distressed property on and then quickly off the market, especially if you generate multiple offers, helps the other homeowner and neighbors the most. The worst markets are where there are homes languishing unsold for months and sometimes years.

On the other hand, when I hear neighbors complain that a listing price is TOO LOW, I suggest they consider creating a partnership and invest in buying the home themselves. (I have seen several do this and benefit financially from it.)

If it's that great a deal and value, the neighbors should take advantage of the situation. If it isn't, the best thing they can do is tell their friends, neighbors and relatives about this great value.

I know it seems unfair that distressed sales are still "comps" however, we all need to work together to get out of this situation. Treating a distressed sale like a normal sale risks the very real danger of your client ending up in foreclosure, the hospital or the morgue-and I'm not willing to gamble my client's health to help someone else feel better about property values. It's wrong and unrealistic.

The California Department of Education recently released the 2009-2010 accountability progress report for statewide schools and districts at http://www.cde.ca.gov/ta/. Naturally parents are curious to discover how their current (or potential) schools are performing in relation to established goals and standards.

For a quick How-to, follow the directions below to find out how your current Cupertino school performed, and perhaps browse through the report to view how others did as well.

Select the first item on the list (see below)

Single family homes are again slightly higher in inventory at 18 for sale and 12 pending. Condos and townhomes remain high in inventory -12 for sale, and 3 pending. While interest rates currently remain low, that is expected to change soon.

Three local young women achieved gold and silver medals at the Math Olympiad in Shijiazhuang, China this week. Out of 190 representatives from 48 teams, these three are students from our local schools. Recent graduates Shiyu "Jing-Jing" Li of Cupertino High and Lynnelle Ye of Palo Alto High earned gold medals. Cynthia Day, a junior at Lynbrook High, earned a silver medal. Congratulations!

The National Moment of Remembrance, established by Congress, asks Americans wherever they are at 3 p.m., local time, on Memorial Day to pause in an act of national unity (duration: one minute).The time 3 p.m. was chosen because it is the time when most Americans are enjoying their freedoms on the national holiday. The Moment does not replace traditional Memorial Day events; rather it is an act of national unity in which all Americans, alone or with family and friends, honor those who died for our freedom. It will help to reclaim Memorial Day as the sacred and noble holiday it was meant to be. In this shared remembrance, we connect as Americans.

How to Participate

Wherever you are, observe the Moment at 3 p.m., local time, on Memorial Day. Ask others to remember—relatives, friends, church, neighborhood, or co-workers to observe the Moment at places such as your neighborhood, local pool, picnic grounds, etc., for one minute of Remembrance. Participation can be informal as ringing a bell three times to signify the Moment.

To provide a time of Remembrance for America’s fallen and to make a commitment to give something back to our country in their memory.To have Americans participate in an act of national unity and demonstrate gratitude and respect for those who died for freedom since the founding of our Nation.To provide a sense of history to our citizens and ensure that younger generations understand the sacrifices made to preserve our liberties.

Background

The idea for the Moment was born when children touring the Nation’s Capital were asked by the Commission’s Director what Memorial Day means. They responded, “That’s the day the pool opens.” A Gallup Poll revealed that only 28% of Americans know the meaning of this noble holiday.The White House Commission on Remembrance was established by Congress (PL 106-579) to promote the values of Memorial Day by acts of remembrance throughout the year. The major initiative of the Commission is the National Moment of Remembrance.

Can you feel the itch and pain of blisters that eventually rupture, only to result in worms as long as three feet coming out of your body, knowing they've already laid more eggs inside and this terror will repeat endlessly throughout your life without hope of respite?

That is the reality and misery of Guinea Worm Disease.

Please consider joining with the Carter Center and signing the petition to eradicate Guinea Worm Disease today.

This horrific disease, which has tortured people in Asia for millennia, is preventable through simple, yet effective, methods including basic filtering and treatment of contaminated water sources. It is one of the few diseases that can be prevented without vaccinations or medical staff.

The Carter Center is leading an international coalition in the Guinea worm disease eradication effort, working at the village level to empower and educate communities to take simple measures like filtering water to get rid of the disease as soon as possible.

Hello! This is Michelle Carr Crowe with your Lynbrook High Homes Update for 05.15.10. I hope you and your family enjoyed a special Mother’s Day last weekend.

I’d love to hear how you spent your Mother’s Day. I enjoyed a lovely Mother’s Day. My husband Steve made me pancakes and strawberries for breakfast. My daughter Marlena brought me a custom-arranged fragrant flower bouquet the day before so I would be sure to enjoy it all day. We shared a special blessing and housewarming party for our most recent home buyers, Manoj & Sree, at their beautiful home in Cupertino Monta Vista. I enjoyed seeing lots of our other clients and friends, too…Anil & Anu, Praveen & Suma and Jose and Betsy. Thank you for including me and my family in your special day.

I also spoke on the phone with several friends and family. It was a bit bittersweet with the recent passing of Steve’s first Mom Kim, but at least she’s no longer in pain.

Monique downloaded FREE tickets for a sneak preview movie, “Letters from Juliet,” which we all enjoyed. The message is, “It’s never too late for true love.” She also took me to Wahoo’s Tacos in Cupertino for a FREE Mother’s Day lunch. Then for dinner we had one of my favorite meals from Frankie, Johnny & Luigi – the family dinner (pizza, salad, spaghetti, barbequed chicken and bread). Steve bought me a few movies from Blockbuster and we watched those till it was time for bed. What a relaxing day.

The Lynbrook High Homes market remains on track for 2010, with demand particularly strong in certain categories, particularly single-family homes under $1M, and steady but at level or slightly decreased prices in others (certain condos and townhomes).

Currently there are 10 single-family homes for sale and 19 pending, showing demand is generally outpacing supply by about 2 to 1. Last week saw townhomes and condos balanced with 10 for sale and 10 pending; this week we have 9 for sale and 11 pending. Perhaps this indicates more movement for townhomes and condos in the near future.

There were 7 single-family home sales this week, ranging in price from $950,000 to $1,300,000 (last week was $917,000 to $1,228,000). There were no TownHome/Condo closings this week.

There are only 17 days left for qualified first-time home buyers in California to act and receive not one just one big credit but two.

For qualified buyers who are in contract by April 30 and close after May 1, they can receive not only up to $8,000 in a federal tax credit, but also up to $10,000 with a California state tax credit.

The Federal program’s purchase price limit is $800,000 and the home must close before June 30, 2010.

The new California program has no price limit, nor is there a limit on income (as there is in the Federal program).

Attention homeowners in San Jose, Cupertino, Saratoga, Santa Clara, Campbell, Palo Alto and all throughout Santa Clara County: property taxes are due and must be paid TODAY to avoid late fees and penalties.

You can either pay in person or online. If in person, it is due in by 5 pm today. If online, it must be fully processed before midnight tonight.

When are secured property taxes due?

The secured property tax bill is payable in two installments: The first installment is due and payable on November 1. However, you have until 5 p.m. on December 10 to make your payment before a 10% penalty and $20.00 cost is added to your bill.
The second installment is due and payable on February 1. The grace period on the second installment expires at 5 p.m. on April 10. If the installment remains unpaid as of April 10, a 10% penalty and $20.00 cost is imposed.
On-line payments can be made at payments.scctax.org prior to midnight Pacific Time on the respective delinquent dates.

Can I pay my Secured Property tax bill with my credit card or e-check?
The Tax Collector's Office provides a web site, where Credit Card and e-check payments can be made.
Credit Cards accepted are: Visa, Master Card, American Express, and Discover.

There are two programs administered by the state that may assist you:
Property Tax Assistance for Senior Citizens or Blind or Disabled Persons The Gonsalves-Deukmejian-Petris Senior Citizens Property Tax Assistance Law provides direct cash assistance based on part of the property taxes paid on the homes of qualified individuals with total household incomes of $40,811.00 or less who are either: (1) 62 or older, (2) blind, or (3) disabled; and a U.S. citizen or eligible alien. Claims for assistance are based on the 2006/2007 property taxes.The filing-period runs from July 1 through October 15. Qualified individuals must file a claim form each year in order to receive assistance. Filing for property tax assistance will not reduce the amount of property taxes owed to the County Tax Collector. California Homebuyer Tax Credit Now Law

This afternoon, Gov. Schwarzenegger signed Assembly Bill 183, the Homebuyer Tax Credit legislation, into law. His actions today are the result of our efforts in Sacramento over the last several weeks as members and our team in the capital worked for the bill’s passage before it landed on the governor’s desk.

AB 183 will provide $200 million for home buyer tax credits, allocating $100 million for qualified first-time home buyers of existing homes and $100 million for purchasers of new, or previously unoccupied, homes. The eligible taxpayer who purchases a qualified personal residence on and after May 1, 2010, and on or before Dec. 31, 2010, or who purchases a qualified principal residence on and after Dec. 31, 2010, and before Aug. 1, 2011, pursuant to an enforceable contract executed on or before Dec. 31, 2010, will be able to take the allowed tax credit. The credit is equal to the lesser of 5 percent of the purchase price or $10,000, in equal installments over three consecutive years. Under AB 183, purchasers will be required to live in the home for at least two years or forfeit the credit (i.e., repay it to the state).

The positive impact of the federal home buyer tax credit is clear. Nearly 40 percent of first-time home buyers said they would not have purchased a home if the federal tax credit for first-time home buyers was not offered, according to C.A.R. research conducted last year.

The state’s previous home buyer tax credit program was so successful that it ran out of tax credits by the end of June 2009, eight months before it was set to expire and just as housing markets appeared to be turning a corner. Unlike last year’s legislation, AB 183 adds a tax credit for the purchase of an existing home by a first-time home buyer.

AB 183 will significantly contribute to the effort to stimulate jobs-creation within California's housing market by helping to incentivize first-time home buyers to purchase homes that have been abandoned, foreclosed upon and returned to the lender, or have been sitting on the market for extended periods of time. It is these homes that will require substantial rehabilitation by the new owners, which will in turn generate a tremendous increase in jobs and accessory purchases connected to home improvement activities.

Nowruz is literally translated as “new day” and acknowledges the spring equinox and the beginning of the Persian and Muslim New Year.

People from all walks of life, including government representatives of the United States have joined together, both in the House of Representatives and the Senate, to acknowledge the holiday of Nowruz and wish Nowruz celebrants well. I’ve included a press release from both the U.S. Senate and Secretary of State Hilary Rodham Clinton. President Barack Obama even videotaped a Nowruz message (click below). Happy Nowruz!

U.S. Senate Passes Nowruz Resolution

March 22, 2010, Washington, D.C. - Today, the U.S. Senate passed by unanimous concent the Nowruz resolution sponsored by Senators Robert Menendez (D-NJ) and John Cornyn (R-TX).

A similar resolution was originally introduced in the House of Representatives by Congressman Michael Honda (CA-15th) and passed on March 15th, 2010. Like the House version, the Senate resolution also recognizes the cultural and historical significance of Nowruz, expresses appreciation to Iranian Americans for their contributions to American society, and wishes Iranian Americans, the people of Iran, and all those who celebrate the holiday a prosperous new year. The Senate version also encourages the peaceful celebration of Nowruz in Iran and supports the right of Iranians to exercise the freedom of assembly, expression, and speech.

While overall inventory remains lower than demand for single family homes, an increasing number of homes are hitting the market each week. We called this project Kenya Dream.

It’s estimated about 30 percent of the population in Santa Clara County leaves the immediate Valley during most three-day holiday weekends.

Economists generally predict either technology or real estate will power the next wave of economic growth. With the recent announcement of fifteen Bay Area students chosen as the prestigious Intel Science Contest semifinalists, it appears Silicon Valley innovation may again power up the nation’s next economic growth cycle.

Fifteen high school seniors who call Silicon Valley home were named semifinalists in the prestigious Intel science contest. Of the fifteen, six were from San Jose's Lynbrook High School.

The six seniors recognized are David Liu, Tony Ho, Akshay Maheshwari, Ritik Malhotra, Tejas Navaratna and Raman Nelakanti.

Part of the well-known "Cupertino Schools," Lynbrook is one of five high schools in the Fremont Union High School District. Students attending Lynbrook reside in either Saratoga or San Jose.

The remaining nine Bay Area students came from Harker Academy, Palo Alto High , Foothill High and Mission High.

Each student was awarded $1,000 personally, as well as $1,000 for his or her respective school.

This year 1,736 entries were received. Of those, 300 semifinalists were chosen, and 28 of them were from California. California has historically received the highest number of semifinalists each year out of all 50 states.

More than half of all California semifinalists this year were from the Santa Clara County / Silicon Valley area, 15 out of 28.

On January 27th, a total of forty finalists nationwide will be selected to win an expense-paid trip for the final competition, held in the nation's capitol, Washington, D.C.

Haiti was already one of the poorest countries in the world, and with the 7.0 earthquake at 4:53 pm on January 12, 2010, this small country received yet another blow.

People around the Bay Area may not realize it, but San Jose and Silicon Valley is home to one of the largest populations of Haitians outside of their native country.
The only good thing about this disaster is perhaps there is a chance to not only help but heal and put in place good infrastructure in place of the previous substandard construction and buildings.

Sadly, corruption in previous administrations has been a troublesome issue for this small country.

For those wishing is most easily and quickly help, there is a text to 90999 feature, which will immediately donate $10 to the Red Cross by billing the $10 to your mobile phone bill. I did verify this as legitimate on Red Cross's official site (www.redcross.org).

Here are some helpful places to connect with loved ones in Haiti, as well as legitimate charities participating in relief efforts. At the Red Cross Family Links registry, 6,000 people connected within the first 24 hours. It is available in both English and French.

FYI, the Red Cross is not accepting volunteers to travel to Haiti. If you would like to volunteer for the American Red Cross, please contact your local chapter.

The International Committee of the Red Cross recommends the following procedure for people searching for relatives in Haiti.

The relative might check the list from his/her new location and contact you. Did you miss it? Amongst the numerous proposals for 2010 in Governor Arnold Schwarzenegger’s State of the State address today one stood out to benefit buyers of both new and existing homes in 2010.

During his State of the State address, Governor Schwarzenegger included in his proposals a recommendation to set aside $200 million for a new round of $10,000 state tax credits for first-time home buyers.

If passed, it increases housing affordability for first-time home buyers throughout Santa Clara County, from Morgan Hill and San Jose to Los Gatos and Saratoga, including Palo Alto and Los Altos to Cupertino and Santa Clara.

The Governor’s new proposal expands upon the initial $10,000 state tax credit by including both new and existing homes.

The 2009 tax credit from last year applied only to buyers of newly constructed homes.

Everyone wants to be in the Top 10…except on Forbes list of most overpriced homes.

This newly updated list features Kissimmee/Orlando, Florida as #1.

To find the cities with the most overpriced homes, they ranked the 40 largest Metropolitan Statistical Areas--geographic entities defined by the U.S. Office of Management and Budget, for use in collecting statistics.

Using data provided to Forbes by Altos Research, a Mountain View, Calif.-based real estate research firm, each metro area was ranked on the following:

1) percentage of homes that had seen price reductions, an indicator of inflated pricing;

2) the median number of days spent on the market (the longer homes stay on the market, the more likely they are to be overvalued);

3) and the ratio of median list price (or asking price) to median absorbed price. As an indicator that other previously overpriced areas have evened out, Las Vegas, Sacramento and San Francisco are all at the bottom (#37-40) of the list.

Imagine my relief as a real estate consultant who specializes in selling homes in San Jose, Santa Clara, Sunnyvale, Saratoga, Los Gatos & Campbell, to find out the great news: Santa Clara is near the bottom! We're number 38! Yay! (Only two areas were lower than us).

An Honest Gardener Named Jose Acosta Made My Thanksgiving Holiday

“Where did I put it?” For hours, I’d been searching the usual places I set my REALTOR® photo ID card and badge holder necklace which also holds my professional identification, debit and credit cards—my desk, my charging station, the car, and next to my bed. No luck.

I was supposed to be packing for our annual family reunion Thanksgiving trip to Disneyland but the mounting anxiety prevented me from moving forward. I kept fussing and double-checking the same places, and then looking in odd ones—my library book bag, the bathroom, the office.

Finally, I began retracing my steps from when I last remembered I had it the night before. I went back to my house, no luck. I went to our neighbor’s house, no luck. As I was sitting in front of their house in my car, forcing myself to praise God in advance for answering my prayer to find it before we had to leave in the next two hours, my phone rang.

“This is Jose Acosta of Acosta’s Gardening Service. Is this Michelle Carr Crowe?” When I responded with a yes, he said the magic words I’d been praying to hear. “I found a wallet with your card and information in it.” He kindly gave me his address and said I could come pick it up from his home that night. He performs the gardening service for a neighbor of ours and had found it in the street where I’d parked my car the night before. Although I had lots of useful info in it, my home address wasn’t in there.

Jose Acosta’s honesty in reporting he found my case, and especially his timeliness in calling me as soon as he’d gotten home from work, truly made my Thanksgiving holiday. His integrity saved me from further anxiety and wasted time, and allowed me to complete my packing in peace, and fully enjoy a long-anticipated family reunion in Disneyland.

This December 12th, Silicon Valley joins Wreaths Across America to honor fallen soldiers with their annual laying of the wreaths ceremony. A non-profit organization honoring both active and fallen soldiers, Wreaths Across America started in 1992 and has grown to 350 participating locations. It first began at Arlington National Cemetary. It’s Raining Blogs…I Mean Meteors…Catch God’s Big Show at 1:00 am, Nov. 17 & 18

Tonight and tomorrow night, God and nature are putting on a free show, the Leonid meteor shower. Like me, try to take a nap during the day so you can stay up to see the fun.

Created by Comet Tempel-Tuttle, the Leonids are an annual event, usually seen in late fall. (Note: Some earlier Internet postings incorrectly attributed it to the Comet Swift-Tuttle.) Each time the Leonid meteor shower passes through the inner solar system it sprinkles debris, (mostly ice and rock), varying in size from as large as a standard marble to as small as a grain of sand.

"We're predicting 20 to 30 meteors per hour over the Americas, and as many as 200 to 300 per hour over Asia," said Bill Cooke of NASA's Meteoroid Environment Office.

According to experts like Cooke, the best time to watch will be from 1:00 am PST through dawn each day. The good news is this year it occurs close to the New Moon phase, enhancing visibility.
Meteor showers are named by the constellation from which meteors appear to fall, a spot in the sky astronomers call the radiant; for example, the Perseid meteor shower’s origin appears to be located near the Perseus constellation, the Leonid’s near Leo (aka the Lion).
This year’s Leonids are reputed to be especially interesting due to its various colored hues, ranging from the usual white or silver to aquamarine or blue.
Tips for viewing:
1) Take at least a 1 hour nap during the day.
2) Go to the bathroom before you leave for your stargazing destination.
3) Find a safe, dark place to watch, one not subject to an onslaught of headlights.
4) Dress warmly with several layers, as well as gloves, hat and overcoat.
5) Bring a bottle of water, and a thermos of hot chocolate, coffee, tea or soup, plus a small snack.
6) Bring a blanket (preferably with a waterproof layer on one side to put on the ground) or a comfy reclining camp chair, PLUS a blanket to snuggle under.
7) Sit or lay back and relax your eyes to maximize your peripheral vision.
8) ENJOY!

For maximum enjoyment, allow at least one hours for viewing; the first 15 minutes will be spent acclimating your eyes to the darkness, then give yourself at least 30 minutes to view. If meteors are falling at 20 per hour, that’s about 1 every 3 minutes; at 30 per hour, that’s 1 every 2 minutes. Assuming you may miss about 20 percent due to looking in the wrong direction or closing your eyes, that means you may see as few as 8 or as many as 15 in 30 minutes.

Dear God…Please bless Noah Biorkman…

Does anyone remember the 1996 movie, “Dear God” starring Greg Kinnear?

In it, a cynical con man must take the only job he can get (in the dead letter department at the post office) as a condition of parole. While there, he finds out there is an entire bin of undeliverable dead letter mail, including dozens of “Dear God” letters. Some of it contains cash, jewelry and other goodies.

Although he initially intends to steal the unclaimed money and valuables from this undeliverable mail, he ends up having a change of heart and leads his colleagues in answering prayers found in the letters.

Most of the time when I receive an email request to send Christmas cards to a sick child or help find a missing child, I’m a bit cynical. I check it out first on Urban Legends or Snopes. About 90 percent of the time it’s either an urban legend or expired (e.g. the missing child was found 2 years ago).

So when my colleague Linda Gonzales sent a request to mail Christmas cards to Noah Biorkman, a young boy with neuroblastoma in Michigan, whose family planned to celebrate Christmas early this weekend, I checked it out first. To my pleasant surprise, it’s a legitimate request. There were links to the local radio station WYCD and Noah’s Care Pages. (The only hiccup was they already celebrated their family Christmas last weekend.)

Tax Credit and Unemployment Benefits Officially Extended & Expanded
The existing tax credit for first-time buyers, originally set to expire at the end of the month, has been extended, expanded and approved by the House, Senate and President Barack Obama. The new measure allows both first-timers and existing homeowners to take advantage of thousands in the form of a tax credit. All properties must close by the end of April.

The measure would continue giving an $8,000 tax credit to first-time buyers.
In addition, it provides a $6,500 tax break to qualified homeowners looking to move up OR MOVE DOWN to middle-market homes that cost no more than $800,000. This can be an important bonus for seniors.

The legislation also significantly raises the qualifying income levels to $125,000 for individual income tax filers and to $225,000 for joint filers.

Finally, the bill would extend unemployment benefits 14 more weeks nationwide and 20 more weeks in California and other hard-hit states. That would give the long-term unemployed nearly two years' worth of benefits.

Lost in the hoopla about extending and expanding the “up to” $8,000 credit for new homebuyers is the credit for existing homeowners. In my opinion, this can be “Senior Salvation” - a tax credit for move-DOWN Saratoga buyers.

I called my broker, my local real estate board, the California Association of REALTORS®, and even the IRS to ask my question: does this credit apply for move-down buyers?

So far the answer is, “As long as they qualify and have a tax to apply the credit to, it looks like YES.”

To summarize:
1. A first time homebuyer is one that has not owned a home for at least three years.
2. A repeat homebuyer must have owned their current home for at least five consecutive years out of the last eight years.
3. The maximum purchase price for the new home is $800,000.
4. If single, your earning maximum to qualify is $125,000; if married, it’s up to $250,000.
5. There's no gap between the prior deadline (November 30th) and the new credit period, which ends April 30th.
6. While you must be in a contract to purchase your new home on or before April 30th, you have until June 30th to close the transaction.
7. To prove you qualify, you'll need to attach proof of purchase to your tax return (most likely a HUD-1 or final closing statement).

Caveat: please, please check with your tax professional and attorney before making any real estate commitments.

However, this may finally be a tax credit that helps seniors who’ve lived in their homes for more than five consecutive years of the past eight.

For example, a senior couple selling a 1.5 million dollar single family home in Saratoga Lynbrook they’ve owned for the past 10 years, then buying a single-level 3 bedroom condo in San Jose for $650,000 not only get to keep their $500,000 tax-free capital gains benefit and transfer their tax basis, they can also now use up to $6,500 as a tax credit.

However, this may finally be a tax credit that helps seniors who’ve lived in their homes for more than five consecutive years of the past eight.

For example, a senior couple selling a $2 million dollar single family home in Cupertino Monta Vista they’ve owned for the past 8 years, then buying a new single-level 2 bedroom condo in San Jose for $650,000 not only get to keep their $500,000 tax-free capital gains benefit and transfer their tax basis, they can also now use up to $6,500 as a tax credit.

And as the capital gains $500,000 tax-free credit is set to EXPIRE as of December 31, 2010, now is a huge window of opportunity for seniors seeking to maximize their benefits.

Tax Credit and Unemployment Benefits Officially Extended & Expanded

The existing tax credit for first-time buyers, originally set to expire at the end of the month, has been extended, expanded and approved by the House, Senate and President Barack Obama.

The new measure benefits a larger group of potential home buyers. It allows both first-timers and existing homeowners to take advantage of thousands in the form of a tax credit. All properties must close by the end of April.

The measure would continue giving an $8,000 tax credit to first-time buyers. In addition, it provides a $6,500 tax break to qualified homeowners looking to move up to middle-market homes that cost no more than $800,000.

The legislation also significantly raises the qualifying income levels to $125,000 for individual income tax filers and to $225,000 for joint filers.

Finally, the bill would extend unemployment benefits 14 more weeks nationwide and 20 more weeks in California and other hard-hit states. That would give the long-term unemployed nearly two years' worth of benefits.

One is to simply smile, and be sure to give your smiles away. Everyone needs encouragement. Besides, it makes you look younger.

Today, Measure G is on the ballot. Below is a synopsis of the proposal. Basically, it is an extension of the existing parcel tax at the same amount of $98, which is set to expire, as well as an annual adjustment for inflation. The measure exempts homeowners who are seniors and/or disabled. Please remember to exercise your right to vote today!

NOVEMBER 3, 2009: MEASURE G

To provide stable, local funds needed to protect teaching positions, and assure that Cupertino, Fremont, Homestead, Lynbrook, and Monta Vista High School students are prepared to successfully compete for college admission, shall the Fremont Union High School District replace its existing, expiring parcel tax with a tax at the same annual rate of $98 per parcel to be adjusted annually for inflation, with all funds benefitting local high schools, and offering an exemption to seniors and the disabled?

According to information for the 2007-2008 Fiscal Year from the California Dept of Education, following is some basic information on district funding dollars per student as compared to all of California as well as other nearby districts with high-performing academic scores.

New Treats for Silicon Valley Home Buyers

By voting to extend the temporarily raised Fannie Mae, Freddie Mac, and FHA loan limits of $729,950 through 2010, Congress gave Buyers (and the U.S. economy which relies heavily on the housing industry) a great big treat. The present loan limits were set to expire at the end of 2009 and revert to previous lower limits of $417,000.
Due to extremely high costs of housing throughout Silicon Valley, especially West San Jose, Cupertino, Los Gatos, Palo Alto and Saratoga, as compared to the rest of the U.S., this good news is especially welcome.
Now buyers are waiting expectantly for one more piece of good news-for the federal $8,000 tax credit to be extended in some form past the current expiration date of Nov. 30, 2009.
The NATIONAL ASSOCIATION OF REALTORS® thanked Congress for its speedy action.
“NAR commends both houses of Congress for their quick action in continuing these higher limits during a time for recovery in the housing market and national economy. The higher limits, along with the home buyer tax credit extension, are necessary to keep the markets moving at this critical time,” said NAR President Charles McMillan.

“Home sales have shown significant movement upwards in the past six months and reduced inventory in some segments of the housing market, but not in all. Home purchases in the middle-income and higher brackets have not moved much, and those markets must improve before we can experience a fully sustained housing recovery. These higher loan limits will help motivate qualified home buyers to purchase in those markets,” McMillan said.

The resolution would extend the present conventional loan limits for Fannie and Freddie through the 2010 calendar year at 125 percent of local median home sales prices, up to a maximum of $729,750 in high-cost areas. The floor for FHA is $271,050; the floor for Fannie Mae and Freddie Mac conforming loan limits is $417,000.

The resolution now goes to President Obama, and he is expected to sign it today or Saturday to avoid an especially nasty trick in the form of government shutdown.

The Best $2 Show I’ve Ever Seen-Cupertino’s Debut Choir Concert

When I was younger and low on cash and seeking inexpensive entertainment, I remember people suggested seeing high school games, musicals or performances as a reasonable option to higher-priced professional events. Current economic times are causing me and others to get back to basics and re-visit this money-saving habit. So when my daughter invited me to see Cupertino High School’s Debut Choir Concert tonight, I said yes. I was even more thrilled once I heard the price!

Tonight I enjoyed a fabulous show featuring talent, poise and professionalism produced by the students at Cupertino High School—and it only cost $2! I have to compliment the students’ director Andrew Aron for his good-natured but firm and no-nonsense direction—to the audience to actually shut OFF their cell phones, behave appropriately (no “shout-outs”) and remove loud talkers from the auditorium.

Each of the four groups (Cantabile, Chorale, Cantos and Capella) performed a selection of classical, touching and at least one crowd-pleasing number. Cupertino High also boasts the only male choir in all of the Fremont High School District. Especially notable were Justin Li’s cello and guitar features and Cody Scott’s solo.

Starting in Latin (“Music Spread Thy Voice Around” by Handel), bouncing through “Lydia, The Tattoed Lady,” hypnotizing with “The Seal Lullaby” and culminating with the Grand Chorus’ uplifting rendition of Moses Hogan’s, “I’ll Make a Difference,” the students demonstrated skill in technique, affection for their director and “the world’s greatest accompanist” Dr. Valerie Stark, and love of music. It was a celebration of joy in music.

Next time you’re looking for reasonably-priced yet real entertainment, I recommend you look at your local middle and high school sports, band and music programs. You may be pleasantly surprised. As advertised, “see your students and friends in a new light.”

There is so much good info out there on the Internet and I love learning new things. I just get tired of looking and feeling stupid when I do it. For example, right now I'm trying to add a button and code to my blog. I am not hip to HTML although I can add links and mailto instructions. I've copied the code verbatim, and I'm praying it works. But if it doesn't, please forgive me if this is a mess. I just had to try it and see if I could do it right. And then I'll get to try something else new again soon.

PERSONAL TO PARENTS OF LYNBROOK SENIORS: The Homecoming Game was tonight. While the team gave a good effort, Lynbrook came in second place. J However, there was more disappointment and heartache for seniors at Lynbrook Homecoming tonight. Apparently (I am hearing this third-hand thru several teens) due to a big point subtraction/DQ/demerit, Seniors took 3rd, while Sophomores & Juniors tied for 1st place. You may want to talk to your Lynbrook teens about feelings and how to handle loss. A lot of people were in shock and crying at the Homecoming Game tonight. Everyone worked so hard for so long to make Homecoming successful (losing a lot of sleep and gaining a lot of stress in the process). Learning how to handle disappointment is an important life skill.

Treats Not Tricks - Grandma Judy's Tips for a Fun & Safe Halloween
Grandma Judy's Rules for Halloween—Making sure You Get Treats not Tricks
My mother Judy Carr, like most children, LOVED Halloween. Most parents like me endure it. Combining an abundance of sugar-rush-inducing candy, the exuberant freedom from inhibitions due to make-believe and costumes and the often opposing ideas of "Halloween fun" between younger and older children can result in a disappointing feeling of being tricked when you expected treats.
Grandma Judy had the usual rules: walk, don't run; have at least 1 partner; only go to houses you know (or at least ones that are well-lit); don't touch the pumpkins or displays; don't eat any candy you received along the way, and listen to your chaperone.
Also, keep in mind the potential for rain, and plan accordingly. There’s nothing worse than wet shoes, a torn costume or a hard fall to spook youngsters and spoil the fun.

Grandma Judy's Tips for Halloween
1) Wear the right shoes! Maybe rain boots don't look right with Ariel's tail but they can help keep little ones from getting wet feet and catching cold.
2) Wear a turtleneck and leggings or thermal shirt and long-johns under costumes. Most commercially-made costumes are made of thin polyester or nylon. It's easy for children's body temperature to dramatically drop when they get cold. Even if you realize it right away, it's still a long trek back home with you looking like a ghoul, dragging along an uncooperative or sobbing child.
3) Make glow sticks and snap-together glow tubes part of the fun. We distribute a few glow sticks to each child – a necklace with one glow stick hanging in the back and one in the front at a minimum. The best way to make it fun for children is to incorporate them into the costume’s design – such as weaving it around the princess crown, making it into “jewelry” or attaching them to the costume or treat container.

4) Use reflective tape in costume and container design. Reflective tape wound around the pirate sword and pieces cut into the shapes of eyes, ears and mouth for the plastic pumpkin help a child be seen. Even better is to streamline – tape along the sides of legs and the arms of children. Or make a design on their backs – spell out BOO, for example.
5) Make a stopwatch part of the fun. If the total time allotted is 1 hour for trick-or-treating, the leader (adult or teenager in charge), sets it first for 30 minutes, then 20, then 10, then 5, then 3 then 1.
6) Plan out and map route in advance, leave it with the adult at home and stick to it. That way if someone does get hurt or lost, the parents know right where to go.
7) Bring at least 2 flashlights, 2 cells phones and 2 watches. Someone always ends up with a dead battery at the worst time, so doubling up is a good idea.
8) Bring along at least 3 pieces of your OWN candy so you can safely snack along the way.

This is an important event where information and assistance is provided not only for those running the risk of foreclosure or are in it, but also for tenants wanting to know their rights and obtain help as well.

There will be representatives from all the major HUD (Housing and Urban Development) certified counseling agencies as well as Legal Aid organizations to provide free and truthful information about the process of foreclosure and what options TENANTS and homeowners have. There will also be a significant number of counseling agencies and a couple of lenders available.
